Terms of Service

1. Scope & Operator

These Terms of Service govern the use of the Inksty platform (the "Platform"), operated by BigHillMedia GbR, Postfach 2078, Mannheim, Germany, contact: info@bighillmedia.com (the "Operator"). By registering you accept these terms as well as our Privacy Policy.

2. Minimum age (youth protection)

Use of the Platform is only permitted to persons who are at least 16 years old. By registering you confirm that you are at least 16. Accounts of minors under 16 will be deleted without prior notice. Parents and legal guardians are asked to supervise the online activity of their children.

3. Registration & account

Registration is required to use core functionality. You agree to provide truthful information, keep your credentials confidential and not transfer your account to third parties. The Operator may suspend or delete accounts for violations of these terms.

4. User content & license grant

You retain all rights in content you upload ("User Content"). You grant the Operator a non-exclusive, worldwide, royalty-free, transferable and sublicensable license to store, reproduce, adapt (e.g. compression), publicly display and distribute such content in connection with operating and promoting the Platform. You represent that you hold all necessary rights and that no third-party rights (copyright, personality, trademark or data protection rights) are infringed. In particular you need the consent of any persons depicted.

5. Prohibited content & conduct

The following content and conduct is strictly prohibited and grounds for immediate suspension and, where applicable, criminal complaint:

• Pornography and sexualized content of any kind, including sexualized nudity, nudism in a sexual context, soft- and hardcore pornography and links to pornographic material.
• Child sexual abuse material and any sexualized depiction of minors — will be reported to the relevant law enforcement authorities without delay.
• Glorification of violence, torture, animal cruelty, self-harm, instructions for or glorification of suicide.
• Incitement to hatred, racist, antisemitic, sexist, homophobic or transphobic content, Holocaust denial and symbols of unconstitutional organizations.
• Hate speech, bullying, cyberbullying, stalking, doxxing and targeted harassment of individuals or groups.
• Threats, calls to violence, terrorist propaganda and recruitment for extremist organizations.
• Insults, defamation, slander and other personality-rights violations.
• Copyright infringement, plagiarism, sale or distribution of third-party tattoo designs without permission.
• Spam, scam, phishing, chain letters, unsolicited advertising, pyramid schemes, fraud attempts and catfishing.
• Malware, viruses, trojans, links to malware or hacking instructions.
• Illegal activities, in particular trade in drugs, weapons, forged documents or stolen data.
• False identities, impersonation of real persons, brands or organizations.
• Publishing third-party personal data without explicit consent (addresses, phone numbers, real names, images, etc.).
• Automated scraping (bots, crawlers) without written permission of the Operator.
• Manipulation of likes, followers or comments and circumvention of technical protection measures.
• Gambling, sale of age-restricted products and advertising of tobacco, alcohol or prescription drugs to minors.

6. Reporting & moderation

Violations can be reported at any time by email to info@bighillmedia.com. The Operator is entitled to review, block or delete reported or self-detected content and to deactivate accounts without prior notice. Content that may be criminally relevant will be reported to the competent authorities.

7. Limitation of liability

The Platform only provides the technical infrastructure. The Operator assumes no liability for user-submitted content; such content does not reflect the Operator's views. There is no general obligation to monitor content in advance.

The Operator is only liable for damages caused by intent or gross negligence, and for damages arising from injury to life, body or health. In the case of simple negligence the Operator is only liable for breach of material contractual duties and only up to the contractually foreseeable damage.

There is no claim to continuous availability, error-free operation or permanent storage of content. Use is at your own risk. Tattoos and tattoo-related content do not constitute medical advice.

8. Data protection

Personal data is processed in accordance with the GDPR and our Privacy Policy. Users under 16 cannot validly consent to data processing under Art. 8 GDPR and may therefore not use the Platform.

9. Termination & deletion

You can delete your account at any time without giving reasons. The Operator is entitled to terminate the usage relationship for cause and without notice in case of violations. After deletion, public copies (e.g. in third-party caches) may remain available for some time.

10. Changes to these terms

The Operator may adapt these terms where necessary for legal, technical or organizational reasons. You will be informed of material changes by email or in the app. If you do not object within 6 weeks, the changes are deemed accepted.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where permitted, exclusive venue is Mannheim, Germany. Should individual provisions be invalid, the remaining provisions remain unaffected.
